FREEDOM OF INFORMATION ACT  2014 (EFFECTIVE DATE FOR CERTAIN BODIES) ORDER 2015

 

I, BRENDAN HOWLIN, Minister  for  Public  Expenditure and  Reform,  in exercise of the powers conferred on me by section 6(5) of the Freedom of Infor- mation  Act 2014 (No. 30 of 2014), with the consent  of the Minister  for the Environment, Community and  Local Government and  the  Minister  for Justice and  Equality,  hereby  make  the  following order,  a draft  of which has been  laid before  each  House  of the  Oireachtas and  a resolution approving  of the  draft has been  passed  by each such House:

Citation

1. This Order may be cited as the Freedom of Information Act 2014 (Effective

Date  for Certain  Bodies)  Order 2015.

Private Residential Tenancies Board

2. The  21st day of April  2012 is the  effective  date  under  section  2(1) of the Freedom of Information Act  2014 (No.  30 of 2014) in the  case of the  Private Residential Tenancies  Board.

Refugee  Applications Commissioner and Refugee  Appeals  Tribunal

3. The  14th day of October 2014 is the  effective  date  under  section  2(1) of the Freedom of Information Act 2014 (No. 30 of 2014) in the case of—

(a)  the Refugee  Applications Commissioner, and

(b)  the Refugee  Appeals  Tribunal.

The Minister  for the Environment, Community and Local Government consents to the making of the foregoing  Order.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

The purpose of this Order is to provide  different effective dates (retrospective dates)  back  to  which the  records  of the  Private  Residential Tenancies  Board, the Refugee  Applications Commissioner and the Refugee  Appeals  Tribunal will be available  under  FOI  once  they  become  public  bodies  under  the  Act  on 14 April  2015. The relevant  effective  dates  are set out in the Order. The standard effective  date  of 21 April  2008 provided  for under  the  Act  will not,  therefore, apply to those  bodies.
